Terms of Service & End User License Agreement (EULA)

This Terms of Service and End User License Agreement (“Agreement”) is a legal contract between you (“User,” “you”) and Burjuva Devs LLC, doing business as Burjuva TradeHub (“Company,” “we,” “our,” or “us”), governing your use of the Burjuva TradeHub software (the “Software”) and related services.

By downloading, installing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.

1. Acceptance of Terms & Software License Grant

The Software is licensed, not sold.
Subject to your compliance with this Agreement and active subscription payment, Burjuva Devs LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on your personal computer for your own educational and research purposes only.
We may periodically require an online license validation to verify your active subscription status.

2. Subscription and Payment Terms

The Software requires an active subscription to function. Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually) until canceled.
Auto-Renewal: Your subscription will automatically renew unless you cancel at least 24 hours before the renewal date.
Cancellation: You may cancel anytime, and access will remain until the current billing period ends. No partial refunds are provided for unused time.
Refunds: Refunds are only issued where required by law or in exceptional cases determined at our sole discretion.

3. Software Updates and License Validation

We may provide updates, patches, or enhancements that are required for continued use of the Software.
The Software periodically connects to our servers to validate your subscription. Failure to verify may suspend or limit your access.

4. User Eligibility and Account Management

You must be at least 18 years old to use the Software.
You are responsible for maintaining your account credentials and for all activity under your account.
You agree to provide accurate information and promptly update your account if it changes.

5. Permitted Use and Prohibited Activities

You agree to:

Use the Software solely for personal, non-commercial, educational, or research purposes. Commercial, corporate, or enterprise use is not permitted under standard subscriptions. Organizations seeking to use the Software for commercial or enterprise purposes must contact us to obtain an Enterprise Plan or a separate licensing agreement..
Comply with all applicable laws and regulations.

You must NOT:

Reverse-engineer, decompile, disassemble, or attempt to derive source code.
Sell, rent, sublicense, or redistribute the Software.
Use the Software to create a competing product.
Circumvent subscription validation or security mechanisms.
Use the Software in any way that may harm or overload our servers or third-party APIs.

6. No Financial Advice & Risk Disclosure

IMPORTANT DISCLAIMER (READ CAREFULLY):

The Software is provided for educational and research purposes only. It does NOT provide financial, investment, or trading advice.
Cryptocurrency trading involves high risk, volatility, and potential for significant financial loss.
Automated trading carries additional risks, including software bugs, internet disruptions, or exchange API errors.
You are solely responsible for any decisions or losses incurred using this Software. We recommend consulting a licensed financial advisor before engaging in real trading.

By using the Software, you acknowledge and accept all associated risks.

7. Limitation of Liability

The Software is provided “as is” without warranties of any kind (express or implied).
We are not liable for:
- Trading losses or missed opportunities.
- Data inaccuracies, exchange outages, or API errors.
- Bugs, software crashes, or failed automation.
To the fullest extent permitted by law, our total liability will not exceed the amount you paid for your most recent subscription period.

8. Privacy & Data Usage

Our Privacy Policy (available at Privacy Policy ) explains how we collect and process personal data.
We may collect anonymized usage analytics and license validation data solely to improve the Software and enforce subscription compliance.

9. Termination or Suspension

We may suspend or terminate your license if you:
- Violate this Agreement.
- Fail to maintain an active subscription.
- Engage in fraudulent or abusive use.

Termination ends your license immediately and disables access to the Software.

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles.

Any disputes arising out of or relating to this Agreement shall be resolved in the state or federal courts located in Bernalillo County, New Mexico, USA, and you consent to their exclusive jurisdiction.

11. Amendments

We may modify these Terms at any time. Updates will be posted within the Software or on our website. Continued use after changes take effect constitutes your acceptance.
